Lucky Horseshoe Wine & Liquors (“we,” “us,” or “our”) operates luckyhorseshoewineliquors.com (the “Site”). This Privacy Policy explains how we collect, use, and safeguard your information in accordance with the New York SHIELD Act and applicable law.

  • Account data: name, email address, date of birth (required for age verification under NYSLA)
  • Order data: items purchased, pickup details, transaction records
  • Usage data: pages visited, search queries, device type, IP address
  • Communications: customer service inquiries

2. How We Use Your Information

  • Verify age as required by the New York State Liquor Authority (NYSLA)

3. NY SHIELD Act — Data Retention

In compliance with the New York Stop Hacks and Improve Electronic Data Security (SHIELD) Act, we retain private information for a minimum of 24 months following the end of our business relationship with you, after which data is securely deleted or anonymized. All private information is encrypted at rest and in transit. Access is restricted to authorized personnel only.

  • Request correction of inaccurate data
  • Request deletion of your data (subject to legal retention requirements)
  • Opt out of marketing communications at any time

5. Security and Breach Notification

We implement reasonable technical and organizational measures to protect your information, including encryption at rest and in transit, multi-factor authentication for administrative access, and regular security reviews as required by our Written Information Security Program (WISP). In the event of a data breach affecting your private information, we will notify affected individuals within 24 hours of discovery and report to the appropriate New York State authorities in accordance with the SHIELD Act.

6. Cookies

We use the following types of cookies:

  • Age verification cookie — set for 30 days after you confirm you are 21+ (required by NYSLA). Prevents you from having to re-verify on each visit.
  • Session cookies — maintain your login state and shopping cart. Cleared when you close your browser.
  • Analytics cookies — help us understand how visitors use the Site (aggregated, non-personally-identifiable data). Google Analytics sets _ga and _ga_* cookies to distinguish unique visitors and track session information.

You can control cookies through your browser settings. Disabling cookies may prevent age verification and certain Site features from functioning.

7. Third-Party Services

We use the following third-party services which may process your data:

  • Supabase — database and authentication (data hosted in us-east-1)
  • Clover — payment processing (credit/debit card transactions; subject to Clover’s PCI-DSS-compliant privacy policy)
  • Resend — transactional email delivery (order confirmations, notifications)
  • Vercel — hosting and CDN
  • Sentry — error monitoring (PII is scrubbed before transmission)
  • Google Analytics — website usage analytics (data processed by Google LLC; subject to Google’s privacy policy)

Each provider has its own privacy policy. We do not sell your personal information to third parties.

8. Children’s Privacy

This Site is intended for users who are 21 years of age or older. We do not knowingly collect personal information from individuals under 21. If you believe we have inadvertently collected such information, please contact us immediately.

9. Changes to This Policy

We may update this Privacy Policy periodically. We will notify you of material changes by posting the updated policy on this page with a revised effective date.
