Terms of Service

These Terms of Service (“Terms”) govern your use of the Lucky Horseshoe Wine & Liquors website at luckyhorseshoewineliquors.com (the “Site”) and any purchases made through it. By accessing the Site you agree to these Terms.

1. Age Requirement

You must be 21 years of age or older to access this Site, create an account, or purchase any product. This requirement is mandated by the New York State Liquor Authority (NYSLA). We verify age using your date of birth at the time of account creation and at pickup. By entering the Site you represent that you are at least 21 years old. We reserve the right to refuse service to anyone who cannot verify their age.

2. Title Transfer

Title to all alcohol passes to the buyer at our Highland, NY location at 591 State Rt 44/55, Highland, NY 12528. No product title passes until a qualified employee of Lucky Horseshoe Wine & Liquors physically releases the product to the purchaser (or their authorized representative) at that location following valid age verification.

3. Products and Ordering

All products listed on the Site are subject to availability. Prices are displayed in US dollars and are subject to change without notice. We reserve the right to limit quantities or cancel orders at our discretion. Placing an order constitutes an offer to purchase; we may accept or decline your order.

4. In-Store Pickup — ID Required

Lucky Horseshoe Wine & Liquors offers in-store pickup only. All orders must be collected in person at:

A valid government-issued photo ID proving age 21+ is required at pickup for every alcohol order without exception. We will not release alcohol products without valid ID verification. We hold your order until 24 hours after the end of your pickup window. An order not collected by then expires and is cancelled, and the items are returned to stock. Nothing is charged for a cancelled order.

5. Delivery Disclaimer (NYSLA)

Lucky Horseshoe Wine & Liquors does not currently offer home delivery of alcoholic beverages. Should delivery services become available in the future, all deliveries of alcoholic beverages will be made in accordance with New York State law, including:

• Delivery only to a person who is 21 years of age or older and who presents a valid government-issued photo ID proving it;
• Delivery requires an adult signature upon receipt — no deliveries will be left unattended;
• Alcohol may not be delivered to visibly intoxicated individuals or to anyone who cannot prove they are of legal drinking age.

Today every order is collected in person at our store, where the ID requirement in section 4 applies.

6. Returns

In accordance with New York State law and NYSLA regulations, we generally do not accept returns of alcoholic beverages once title has transferred. Exceptions may be made solely at our discretion for:

• Products that are corked, damaged, or otherwise defective;
• Errors in order fulfillment on our part.

To report a product issue, contact us at support@luckyhorseshoewineliquors.com within 48 hours of pickup.

7. Pricing and Payment

All prices are in US dollars. New York State and local sales tax is added at the register. Nothing is charged when you place an order online, and this Site does not collect card details. You pay in full at our register when you collect your order, by cash, debit card or credit card. We release an order only after full payment and valid ID verification. In line with New York law, we do not sell on account, run tabs or carry a balance.

8. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

9. Intellectual Property

All content on this Site — including text, images, logos, and code — is owned by or licensed to Lucky Horseshoe Wine & Liquors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

10. Disclaimer and Limitation of Liability

The Site and its content are provided “as is” without warranties of any kind. To the fullest extent permitted by law, Lucky Horseshoe Wine & Liquors shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our products.

11. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ulster County, New York.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes constitutes acceptance of the revised Terms.
